Damian McCarthy: Relentless, focussed and outstanding results

 

I have a reputation for two things: getting to the heart of a case quickly and fighting “tooth and nail” for my clients.

I specialise in whistleblowing, discrimination, harassment and dismissal claims. I have represented high profile clients, such as Moira Stuart and HBOS and have over twenty years experience in employment law, at the highest levels.

 

I am passionate about protecting my clients interests and work hard to understand their case in order to develop a winning strategy. It is a matter of professional pride that I have taken on some very difficult cases and achieved outstanding results. As mentioned, I acted for Moira Stuart in her claim against the BBC and for HBOS against Tansey in a sexual harassment claim. Both cases received nationwide media attention and I achieved outstanding results in both cases.

 

I enjoy guiding clients safely through the difficulties they face in Employment Tribunal claims and take winning cases personally.

 

I have been regularly hired by the biggest law firms in the UK to represent their clients and have built up a reputation as a tough and effective Advocate. I am proud to say that I am no longer a self-employed Barrister without support staff, but am now a Senior Advocate at Nationwide Employment Lawyers with support staff and a team of lawyers.

 

Most of my cases have been high profile dismissal, discrimination or “whistleblowing” claims. Occasionally I take on less high profile cases if I have capacity.

 

I have extensive experience in representing clients in Employment Tribunals in cases that vary from 1 day unfair dismissal claims 25 – 30 day complex discrimination cases. I regularly work with companies, Human Resource managers, local authorities, trade unions and individual claimants who need employment law advice and representation.

I am an Employment Law specialist and an Advocate, with over 20 years experience. I specialise in claims of whistleblowing, discrimination, harassment and dismissal pursued in the Employment Tribunal.

Specialist areas of law:

  • Whistleblowing claims: I have represented high-profile whistleblowers within the NHS, as well as accountants, high profile business people and professionals. I am recognised as a leading specialist in this area;
  • Discrimination claims: I have specialised in discrimination claims for over 20 years and have represented clients in numerous complex cases. I advise and represent in all aspects of these claims and have done so very successfully.
  • Harassment claims: this is a niche area in which I have represented clients in very high profile claims. I am regularly approached to represent clients in difficult harassment cases because I have a wealth of experience in this area and am recognised as a leading advocate;
  • Stress at work and bullying claims: I have been at the forefront of these claims for over 20 years. I advise and represent clients in difficult cases and am asked to lecture other lawyers and professionals on this developing area of law.
  • Dismissal claims: many of the above claims also involve a dismissal of the Claimant. It is important to recognise how the law has developed and been refined over the last few years in order to ensure success. I have tended to specialise in discrimination claims and stress and bullying/harassment claims. Many clients approach me because of my experience in this area.

I also represented the client in ET and the EAT (with Robin Allen QC) in Sharp v Caledonia, a case which had a dramatic impact on equal pay cases.
